Recusación formulada en contra del magistrado Jorge Enrique Ibáñez Najar. el ciudadano censuró la objetividad del precitado magistrado para participar en la decisión del proceso de la referencia.
Constató la Corte que el peticionario no acreditó su legitimación en la causa para presentar la recusación, en la medida en que no concretó su interés dentro del proceso, por cuanto no intervino como impugnador o defensor de las disposiciones sometidas a control constitucional en el término de fijación en lista.
Con base en lo anterior, se RECHAZÓ la recusación impetrada por falta de pertinencia.
